Diverse West-Europese jeugdrechtssystemen zijn de laatste decennia punitiever geworden. Dit artikel onderzoekt of het Belgische jeugdrechtssysteem, van oudsher een van de de meest welzijnsgeoriënteerde in Europa, ook een punitievere wending heeft genomen. Een analyse van de recente wijziging van het meest bestraffende element in het Belgische jeugdrecht, de uithandengeving, biedt geen definitief antwoord. De regelgeving inzake de overdracht werden niet harder gemaakt door de nieuwe Jeugdwet. We zullen echter betogen dat de wijziging, hoewel 'mild' op het eerste gezicht, in de praktijk kan leiden tot een repressieve verschuiving. |

Several Western European juvenile justice systems have become more punitive in the last few decades. This article explores whether the Belgian juvenile justice system, traditionally one of the most welfare oriented in Europe, has taken a punitive turn as well. An analysis of the recent amendment of the most punitive element in the Belgian juvenile justice system, transfer to Adult Court, does not provide a defi nite answer. The regulations on transfer were not made harsher by the new Youth Act. However, we will argue that the amendment, although ‘mild’ at fi rst sight, may, in practice, result in a punitive shift. |
