Deze minimumstandaarden bevatten aan aantal basisbeginselen voor de promotie van maatregelen andere dan hechtenis, alsook minimumstandaards voor personen die aan alternatieve straffen onderworpen zijn. Deel I begint met algemene beginselen (fundamentele doelen, bereik, wettelijke beschermingsmechanismes en een uitzonderingsbepaling). Deel II weidt uit over het vooronderzoek, terwijl Deel III gaat over het proces en de eigenlijke berechting, en Deel IV over de periode daarna. In Deel V wordt de implementatie van maatregelen ander dan hechtenis uiteengezet (toezicht, duur, voorwaarden, behandelingsproces, discipline en breuk van de voorwaarden). Deel VI zegt een aantal woorden over personeel, alvorens Deel VII ingaat op vrijwilligers en gemeenschapsdiensten. Tenslotte concludeert Deel VIII met een aantal bepalingen inzake onderzoek, planning, beleidsformulering en evaluatie. |
| Summary: |
The present Standard Minimum Rules provide a set of basic principles to promote the use of non-custodial measures, as well as minimum safeguards for persons subject to alternatives to imprisonment. In Part I, it starts with addressing the general principles (fundamental aims, scope, legal safeguards and a saving clause). Part II elaborates upon the pre-trial stage, Part III the trial and sentencing stage and Part IV the post-sentencing stage. Part V then discusses the implementation of non-custodial measures (supervision, duration, conditions, treatment process, and discipline and breach of conditions). Part VI says a few words about staff. Then, Part VII talks about volunteers and other community resources, before Part VIII concludes with a number of provisions on research, planning, policy formulation and evaluation. |
