Dit Verdrag, in lijn met artikel 21 VRK, was ontwikkeld om safeguards vast te stellen die ervoor zorgen dat interlandelijke adoptie altijd in het belang van het kind is en de fundamentele rechten van het kind respecteert. Het Verdrag erkent dat het opgroeien in een familiale omgeving van groot belang is voor het geluk en de gezonde ontwikkeling van het kind. Het erkent eveneens dat interlandelijke adoptie het voordeel biedt van een permanente familie voor een kind voor wie in zijn of haar geboorteland geen passende familie kan gevonden worden. Door duidelijke procedures uiteen te zetten en onverantwoorde financiële winst te verbieden, voorziet het Verdrag in meer veiligheid, voorspelbaarheid en transparantie voor alle partijen die bij de adoptie betrokken zijn. Het Verdrag stelt ook een samenwerkingssysteem tussen autoriteiten in het land van oorsprong en het land van bestemming op, wat speciaal ontworpen is om ervoor te zorgen dat interlandelijke adoptie plaatsvindt onder voorwaarden die ertoe bijdragen de beste adoptiepraktijken te garanderen en misbruik uit te roeien. |
| Summary: |
In line with Article 21 CRC, this Convention was developed to establish safeguards ensuring that intercountry adoptions take place in the best interest of the child and with respect for the child’s fundamental rights. The Convention recognises that growing up in a family is of primary importance and is essential for the happiness and healthy development of the child. It also recognises that intercountry adoption may offer the advantage of permanent family to a child for whom a suitable family cannot be found is his or her country of origin. By setting out clear procedures and prohibiting improper financial gain, the Convention provides greater security, predictability and transparency for all parties to the adoption. The Convention also establishes a system of co-operation between authorities in countries of origin and receiving countries, designed to ensure that intercountry adoption takes place under conditions which help to guarantee the best adoption practices and elimination of abuses. |
