Het Verdrag behandelt één van de belangrijkste thema’s binnen de Raad van Europa: omgang met kinderen en de mogelijke beperkingen hiervan, wanneer deze nodig zijn in het belang van het kind. Het doel van het Verdrag is de verbetering van een aantal aspecten van het recht op binnenlandse en grensoverschrijdende omgang. Het Verdrag specificeert in het bijzonder het recht van kinderen en hun ouders om op regelmatige basis contact te onderhouden. Zo nodig kan dit recht ook uitgebreid worden naar contact tussen het kind en een niet-ouder, vooral wanneer het kind familiebanden met deze persoon bezit. In dit opzicht bepaalt de Conventie de algemene beginselen die op omgangsregelingen kunnen worden toegepast. Het legt ook passende maatregelen en garanties vast, zowel met betrekking tot het verzekeren van een goed verloop van het contact, als tot een onmiddellijke terugkeer van de kinderen aan het eind van de contactperiode. Ook behandelt het Verdrag de samenwerking tussen alle betrokken instellingen en autoriteiten, en versterkt het de implementatie van relevante bestaande juridische instrumenten in dit gebied. Het Verdrag richt zich ook op niet-lidstaten van de Raad van Europa en zal dus ook voor hen openstaan voor toetreding. |
| Summary: |
The Convention deals with one of the Council of Europe's major concerns: contact with children and the possible restrictions thereto, when these are considered necessary in the best interests of the child. The aim of the Convention is to improve certain aspects of the right of national and trans-frontier contact and, in particular, to specify and reinforce the basic right of children and their parents to maintain contact on a regular basis. This right may be extended, if necessary, to include contact between a child and other persons than his or her parents, in particular when the child has family ties with such a person. In this respect, the object of the Convention is to determine the general principles to be applied to contact orders, as well as to fix appropriate safeguards and guarantees to ensure the proper exercise of such contact and the immediate return of children at the end of the period of contact. It establishes co-operation between all the bodies and authorities concerned with contact orders and reinforces the implementation of relevant existing international legal instruments in this field. The Convention also addresses non-member States of the Council of Europe and will therefore also be open to their accession to this Convention. |
