De problematiek van het gebruik van de pedagogische tik in de opvoeding stond de voorbije decennia hoog op de agenda als gevolg van de goedkeuring en implementatie van het VN-Verdrag inzake de rechten van het kind. Hoewel dit verdrag de pedagogische tik niet expliciet verbiedt, werd het gebruik ervan geproblematiseerd door tal van (niet-)gouvernementele kinderrechtenorganisaties, in die mate dat het pleidooi voor een verbod op het gebruik van lijfstraffen in de opvoeding vandaag kan worden beschouwd als een speerpunt in de strijd voor rechten van kinderen. De discussie wordt vandaag vooral gevoerd vanuit twee vragen. Een eerste vraag betreft de pedagogische opportuniteit van straffen in de opvoeding. Een tweede vraag gaat over de wenselijkheid tot en met de noodzaak van een gesanctioneerd verbod van de pedagogische tik. Dit artikel bespreekt deze beide vragen en de discussies er rond. |

The problem of the use of hitting or smacking for the sake of discipline in the upbringing, however light, has been high on the agenda, due to the adoption and the implementation of the UNCRC. Whilst this treaty does not explicitly prohibit disciplinary measures involving physical contact, their use has been problematized by a number of (non-)governmental children’s rights organizations, in such a high degree that the prohibition on the use of corporal punishment nowadays can be seen as a priority in the battle for children’s rights. Today, this discussion is mainly based on two questions. The first one questions the pedagogical opportunity of punishments in the upbringing. The second one concerns the desirability and the need of a penalized prohibition of the pedagogical tap. This article explores both questions, as well as the discussions around them. |
