Samenvatting: In deze opinie verwelkomt PACE het stipte ontwerp van de Draft Convention on the Protection of Children Against Sexual Exploitation and Sexual Abuse. PACE ziet de draft als een belangrijke stap in de beschermings van kinderen tegen deze weerzinwekkende vormen van geweld en misbruik. Volgens PACE past het toekomstige verdrag perfect in het kader van de RvE strategie “building a Europe for and with children”. Een aantal amendementen worden voorgesteld met het oog op een verbetering van het verdrag.
Summary: In this opinion, PACE welcomes the speedy preparation of the draft convention on the protection of children against sexual exploitation and sexual abuse. It considers this draft to be a major step forward in the protection of children against this particularly repugnant kind of abuse. It considers the future convention to fit in perfectly with the CoE strategy “building a Europe for and with children”. A number of amendments are proposed with a view to improve the draft convention.

Samenvatting:	In deze opinie verwelkomt PACE de voorbereiding van een Draft Convention of the Council of Europe on the Adoption of Children (herzien). De Draft wordt gezien als een belangrijke stap, zowel omdat het de nodige update inhoudt voor het 1967 Europees verdrag inzake adoptie van kinderen (ETS No. 58), alsook omdat het relevante internationale standaarden aanvult. Volgens PACE past het toekomstige verdrag perfect in het kader van de RvE strategie “building a Europe for and with children”. Het zet het concept van het belang van het kind centraal binnen adoptieprocedures, in overeenstemming met gevestigde rechtspraak van het EHRM. Een aantal amendementen worden voorgesteld om de Draft te verbeteren.
Summary:	In this opinion, PACE welcomes the preparation of the draft convention of the Council of Europe on the adoption of children (revised). It regards this draft as a significant and necessary step forward, given the general recognition of the need to update the 1967 European Convention on the Adoption of Children (ETS No. 58), and the way in which the draft complements relevant international standards. PACE finds the future revised convention to be perfectly integrated with the CoE strategy “building a Europe for and with children”. It makes the concept of the child’s best interests central to adoption procedures, in accordance with the well-established case law of the European Court of Human Rights. A number of amendments are proposed with a view to improve the draft convention. PACE uses the following key words for this opinion: adoption of a child; anti-discriminatory measure; children's rights; discrimination on the basis of sexual orientation; international adoption.

Samenvatting:	In deze opinie verwelkomt PACE de Draft Council of Europe convention on preventing and combating violence against women and domestic violence. De Vergadering verwelkomt in het bijzonder de uitgebreide en holistische aanpak van de Draft, waarin de preventie van geweld tegen vrouwen, de bescherming van slachtoffers, de vervolging van daders en een geïntegreerd beleid tegelijkertijd aan bod komen. Ook prijst PACE het toezichtmechanisme en de innovatieve bepalingen inzake de specifieke rol voor nationale parlementen en de Parlementaire Vergadering bij het toezicht en de implementatie van het verdrag. Een aantal amendementen worden voorgesteld om de bepalingen in het verdrag te versterken. In het bijzonder nodigt PACE het Comité van Ministers uit om drie aanvullende protocollen te ontwerpen, die respectievelijk de kwetsbare situatie van kinderen, gehandicapten en ouderen behandelen.
Summary:	In this opinion, PACE warmly welcomes the draft Council of Europe convention on preventing and combating violence against women and domestic violence. The Assembly welcomes the comprehensive and holistic approach of the draft convention, which encompasses simultaneously the prevention of violence against women, the protection of victims, the prosecution of perpetrators and integrated policies. It also commends the strong monitoring mechanism foreseen by the draft convention, as well as the innovative provisions setting out a specific role for national parliaments and the Assembly in the context of monitoring the implementation of the convention. A number of amendments are proposed with a view to strengthening the standards set out in the draft convention. In particular the Assembly invites the Committee of Ministers to consider drafting three additional protocols to the draft convention, respectively on children, disabled people and elderly people. PACE uses the following key words for this opinion: European convention; sexual violence; domestic violence; additional protocol; opinion to the Committee of Ministers.

Samenvatting:	In deze opinie betreurt PACE dat de Draft Convention on the Exercise of Children’s Rights slechts enkele suggesties die de Vergadering eerder gemaakt had verwerkt. Hoewel PACE ervan overtuigd is dat de positie van kinderen tijdens familierechtelijke procedures versterkt zal worden en dat de uitoefening van hun procedurele rechten zal verbeteren, is de Vergadering bezorgd dat de Draft een te ruime beoordelingsvrijheid aan de lidstaten overlaat inzake de toepasbare bepalingen. Gezien het feit dat het belangrijkste doel van dit Verdrag erin bestaat om tot een gemeenschappelijke Europese positie te komen wat betreft de uitoefening van kinderrechten, vindt de Vergadering het noodzakelijk dat een aantal minimale procedurele rechten van kinderen door alle contracterende staten moet worden aangenomen.
Summary:	In this opinion, PACE regrets that the draft convention on the exercise of children’s rights takes up only some of the proposals the Assembly had made earlier. Also, even though the Assembly is convinced that the position of children in court during family proceedings will be strengthened and that the exercise of their procedural rights will be promoted, it is concerned that the draft convention leaves a broad margin of discretion to the contracting states regarding the choice of applicable provisions. Considering that the main purpose of this convention is to arrive at a common European position on the exercise of children's rights, the Assembly believes that a certain minimum of the procedural rights of children should be accepted by all states signatories to the convention. Consequently, the Assembly recommends that the Committee of Ministers make a number of amendments with a view to improving the draft convention. Samenvatting:	In deze opinie verwelkomt PACE het stipte ontwerp van een verdrag inzake omgang met kinderen. De Draft doelt op de invoering van een verbeterd omgangssysteem, wat kinderen zou bijstaan in het behoud van regelmatig contact met hun beide ouders, alsook met andere familieleden of verwanten. De Vergadering vindt dat de Draft goed uitgerust is om haar doel te bereiken, en vindt eveneens dat het verdrag bestaande internationale normen goed aanvult. Toch betreurt PACE dat de Draft een te grote beoordelingsvrijheid toestaat aan de staten. Gezien de tekst voor het grootste deel zeer modern en verregaand is, zou het verkieslijk zijn wanneer het verdrag minder overliet aan de nationale koers van ieder land.
Summary:	In this opinion, PACE welcomes the timely drafting of a convention on contact concerning children. The draft convention aims at setting up an improved system of contact, which would assist children in maintaining regular contact with both their parents and with other people with whom they have family or other ties. The Assembly considers the draft convention to be well geared to the aims it is meant to achieve, and finds that it complements the other relevant international legal texts well. However, PACE regrets that the draft convention is drafted in a way which allows states considerable margins of appreciation. Considering that the draft convention is, in most aspects, very modern and far-reaching, it would be preferable if the convention could leave less to the determination of the domestic law of each state.
