Samenvatting: Het doel van de auteur is om de naleving van internationale juridische normen te promoten. Hij doet dit door de kruispunten tussen de mensenrechten van jonge mensen en herstelrecht naar voren te brengen. Dit gebeurt voor juridische theoretici door het voorstellen van een trans-disciplinair denken en voor mensen in de praktijk door de zogenaamde ‘Rights Based Restorative Practice Evaluation ToolKit”, ontwikkeld op basis van dit conceptuele kader. Deze omvattende aanpak werd ontwikkeld binnen de Canadese contexten van recht, sociaal beleid en jeugdrecht. Ondanks mogelijke vertekening als gevolg van het culturele of politieke milieu, stellen de auteurs dat een herstelrecht gebaseerd op rechten zou kunnen bijdragen tot een vooruitgang van de ethische praktijk in vele lidstaten van de VN die trachten deze gemeenschappelijke kaders aan te nemen.
Summary: The authors' aim is to promote compliance with international legal standards by articulating intersections between young people's human rights and restorative justice principles — for legal theorists through transdisciplinary thinking and for practitioners by introducing the Rights Based Restorative Practice Evaluation ToolKit developed through this conceptual framework (Moore, 2008). This comprehensive approach was developed within the Canadian legal, social policy and youth justice contexts. Notwithstanding potential bias stemming from cultural or political milieu, the authors argue that rights-based restorative justice could contribute to the advancement of ethical practice in many UN-member states attempting to adopt these common frameworks.

Samenvatting:	Dit artikel onderzoekt de draagwijdte van vrijheidsberovende straffen voor kinderen in Engeland en Wales en plaatst dit in de context van het artikel 37 van het IVRK. Gebaseerd op een recent onderzoek, uitgevoerd door NACRO in opdracht van de Youth Justice Board for England and Wales, wordt het bewijs herzien voor de het bestaande ‘gerechtigheid door geografie’ in termen van het gebruik van detentie, en worden factoren onderzocht die de verschillen in de praktijk van het bestraffen mogelijk verklaren. Tot slot wordt een evaluatie gemaakt van het vooruitzicht om de recente trend om te keren waarbij in een toenemend aantal gevallen kinderen van hun vrijheid worden beroofd, in het licht van de huidige ontwikkelingen in beleid en praktijk.
Summary:	This article examines the extent of custodial sentencing of children in England and Wales and locates it within the context of Article 37 of the United Nations Convention on the Rights of the Child. Drawing on a recent survey, undertaken by NACRO on behalf of the Youth Justice Board for England and Wales, the evidence for the existence of ‘justice by geography’ in terms of the use of custody is reviewed, and factors which might account for variations in sentencing practice are explored. Finally, an assessment is given of the prospects for reversing the recent trend to deprive increasing numbers of children of their liberty, in the light of current developments in policy and practice.

Samenvatting:	Dit artikel onderzoekt de praktijk van één bijzondere vorm van gesloten verblijf: de bijzondere jeugdzorg. Het begrip suggereert dat dit een welvaartsgeoriënteerd antwoord is op normoverschrijdend gedrag van jongeren. Het empirische voorbeeld is afkomstig uit Finland, waar bijzondere jeugdzorg wordt verstaan als restrictieve activiteit in het kader van de Child Welfare Act en die gericht is op, onder andere, het doorbreken van de vicieuze cirkel van misdaad bij jongeren in het belang van het kind. Een tegenstrijdig beeld van bijzondere jeugdzorg wordt geschetst. Het artikel stelt voor dat de tegenstrijdigheden moeten worden verstaan, maar niet noodzakelijk worden aanvaard, binnen de sociale context waarbinnen de plaatsingen in instellingen plaatsvinden.
Summary:	The article studies the practice of one special form of closed accommodation: special care. The term suggests that this is a welfare-oriented response to norm-breaking behaviour of young people. The empirical example comes from Finland, where special care is defined as restrictive activity under the Child Welfare Act and aimed at, among other things, interrupting a vicious circle of crime in young people for the best interests of the child. A contradictory picture is drawn of special care. The article suggests that the contradictions should be understood — but not necessarily accepted — within the social context in which the institutional placements take place.

Samenvatting:	Aparte systemen van berechtiging voor kinderen en jongeren zijn steeds het onderwerp geweest van tegenspraak en compromissen. Er bestaat overtuigend bewijs dat een dergelijke ambiguïteit momenteel wordt omzeild door een grotere toevlucht door de overheid tot neo-conservatieve bestraffende en correctionele interventies en een neo-liberale responsabiliseringsmentaliteit waarbij de bescherming die historisch werd toegekend aan kinderen snel uiteenvalt. Deze heropleving van het autoritarisme lijkt eens te meer in te gaan tegen de tijdsgeest wanneer het tegenover het breed aanvaarde engagement wordt geplaatst om te handelen binnen de richtlijnen die worden aangegeven door verscheidene kinderrechtenverdragen. Hierbij dient het IVRK van de Verenigde Naties vermeld, dat vaak wordt beschreven als het meest geratificeerde mensenrechtenverdrag ter wereld, maar dat helaas ook het verdrag is dat het meest geschonden wordt. Gebaseerd op internationaal onderzoek naar cijfers inzake detentie van jongeren en het respecteren van kinderrechten in de VSA en West Europa, onderzoekt dit artikel waarom en in hoeverre het ‘Amerikaanse uitzonderingsgedrag’ zou kunnen doordringen in de Europese landen.
Summary:	Separate systems of justice for children and young people have always been beset by issues of contradiction and compromise. There is compelling evidence that such ambiguity is currently being `resolved' by a greater governmental resort to neo-conservative punitive and correctional interventions and a neo-liberal responsibilizing mentality in which the protection historically afforded to children is rapidly dissolving. This resurgent authoritarianism appears all the more anachronistic when it is set against the widely held commitment to act within the guidelines established by various children's rights conventions. Of note is the United Nations Convention on the Rights of the Child, frequently described as the most ratified human rights convention in the world, but lamentably also the most violated. Based on international research on juvenile custody rates and children's rights compliance in the USA and Western Europe, this article examines why and to what extent `American exceptionalism' might be permeating European nation states.
