| | Samenvatting: | In dit verslag onderzoekt de Special Rapporteur inzake de onafhankelijkheid van rechters en advocaten de bescherming van de Rechten van het Kind binnen het justitieel systeem. Ook analyseert zij de essentiële rol die rechters, aanklagers en advocaten hebben in de handhaving van mensenrechten van kinderen en het toepassen van internationale normen, standaarden en principes van mensenrechten op nationaal niveau. De Special Rapporteur heeft getracht verder te gaan dan de meer beperkte notie van het jeugdrecht, om zo aan de uiteenlopende ervaringen van de kinderen tegemoet te komen wanneer ze in aanraking komen met het rechtssysteem als slachtoffer of getuigen, omdat ze in strijd zijn met de wet, of als partijen in een gerechtelijke procedure. De Special Rapporteur concludeert dat investeren in kindersensitieve justitie van groot belang is om de rechtstaat te versterken en zowel tegemoet te komen aan de Mensenrechten als om te werken aan bloeiende democratische samenlevingen. In alle aspecten van het rechtssysteem , hebben kinderen bijzondere rechten, behoeften en belangen waaraan prioriteit moet gegeven worden. | | Summary: | In the present report, the Special Rapporteur on the independence of judges and lawyers examines the protection of children’s rights in the justice system and analyses the essential role that must be played by judges, prosecutors and lawyers in upholding children’s human rights and applying international human rights norms, standards and principles at the domestic level. The Special Rapporteur endeavoured to go beyond the more limited notion of juvenile justice, so as to reflect the diverse experiences of children when they encounter the justice system as victims or witnesses, because they are in conflict with the law, or as parties to judicial proceedings. The Special Rapporteur concludes that investing in child-sensitive justice is indispensable to strengthening the rule of law and the enjoyment of human rights by all, as well as to building flourishing democratic societies.
