Na de behandeling van hun achtergrond, inclusief hun geschiedenis en de verschillende soorten effecten van de mensenrechten, zullen de verschillende toepassing van HRIAs, namelijk compliance, beleidsvorming, verantwoording en empowerment worden onderzocht. Vragen met betrekking tot de ontwikkeling van HRIAs zullen ook worden geanalyseerd. Er zal worden onderzocht of HRIAs in andere soorten effectbeoordelingen moeten worden opgenomen en hoe de impact op de rechten van de mens kan worden bepaald. In het artikel, worden de drie fasen in de uitvoering van HRIAs, namelijk de analytische proces, de deliberatieve proces en de monitoring en evaluatie, vervolgens geanalyseerd, hen opdelend in verschillende stappen. Tot slot zullen de verschillende actoren die deelnemen aan HRIAs worden behandeld. Deze zijn beleidsmakers, experts mensenrechten, maatschappelijke organisaties, nationale instellingen van de mensenrechten, en getroffen mensen. Summary: In this article human rights impact assessments (HRIAs) will be discussed. After examining their background, including their history and the different kinds of human rights impact, the various purposes of HRIAs, namely compliance, policymaking, accountability and empowerment will be examined. Questions relating to the development of HRIAs will also be analysed. It will be examined whether HRIAs should be incorporated into other kinds of impact assessments and how impact on human rights can be determined. In the article, the three phases in carrying out HRIAs, namely the analytical process, the deliberative process, and the monitoring and evaluation, will be subsequently analysed, dividing them into different steps. Finally, the various actors taking part in HRIAs will be dealt with. These are policy-makers, human rights experts, civil society organisations, national human rights institutions, and affected people. Onderwijs:Zorg op schoolSamenvatting: Artikel 24 van het VN-Verdrag inzake de rechten van personen met een handicap (verder VRPH) waarborgt het recht op onderwijs voor personen met een handicap. Het stelt het principe van het inclusief onderwijs voorop, dat kinderen met een handicap moet toelaten deel te nemen aan het algemeen onderwijssysteem. Deze bijdrage biedt een grondige analyse van artikel 24 van het VRPH. Het bespreekt het recht op onderwijs en bestudeert de betekenis van artikel 24 van het VRPH, waaronder het begrip van het inclusief onderwijs, alsook de redelijke aanpassingen en de ondersteuningsmaatregelen die moeten genomen worden om het inclusief onderwijs waar te maken. Het kijkt ook kort naar de implementatie van artikel 24 van het VRPH in Vlaanderen en staat stil bij de recente initiatieven van de Vlaamse Regering om de wetgeving dichter bij artikel 24 van het VRPH te brengen. Summary: Article 24 of the UN Convention on the Rights of Persons with Disabilities (hereafter CRPD) guarantees the right to education of persons with disabilities. It provides the principle of inclusive education which should allow children with disabilities to participate in the general education system. This contribution gives an in-depth analysis of Article 24 of the CRPD. It discusses the right to education and studies the meaning of Article 24 of the CRPD, including the concept of inclusive education, as well as the reasonable accommodations and support measures that have to be taken in order to achieve inclusive education. It also looks briefly at the implementation of Article 24 of the CPRD in Flanders and considers the recent initiatives of the Flemish government to bring legislation closer to Article 24 of the CRPD. Onderwijs:Zorg op schoolSamenvatting: Dit artikel handelt over het recht op inclusief onderwijs. Artikel 24 van het VN Verdrag voor de Rechten van Personen met een Handicap (IVRPH) houdt niet enkel in dat kinderen met een beperking niet mogen gediscrimineerd worden, maar ook dat ze in staat moeten zijn om deel te nemen in het algemene onderwijssysteem. Kinderen met een beperking zouden daarom onderwezen moeten worden in reguliere scholen. Het artikel start met het bestuderen van het recht op onderwijs in de internationale mensenrechtenwetgeving. Hierop volgt een algemene introductie over het IVRPH. Na een discussie over haar ontstaansgeschiedenis, volgt een analyse van Artikel 24 van het IVRPH, waarbij het concept van inclusief onderwijs onderzocht wordt, de plicht om redelijke accommodatie te voorzien en de verplichting om ondersteuningsmaatregelen te treffen. Hierbij wordt de vraag gesteld of speciale scholen nog steeds beschikbaar zouden moeten zijn. Summary: This article deals with the right to inclusive education. Article 24 of the UN Convention on the Rights of Persons with Disabilities (CRPD) provides not only that children with disabilities should not be discriminated against but also that they should be able to participate in the general education system. Children with disabilities should therefore be educated in mainstream schools. The article begins by studying the right to education in international human rights law (Section 2). It continues with a general introduction to the CRPD (Section 3). After discussing its drafting history, the article goes on to analyse Article 24 of the CRPD, examining the concept of inclusive education, the duty to provide reasonable accommodation and the obligation to adopt support measures and asking the question whether special schools should still be available (Section 3).
