Vanuit een internationaal mensenrechtenperspectief, overweegt het artikel twee mogelijke clashes van rechten die ontstaan bij MBVT-kinderen: het gebruik van MBVT als kindermisbruik en een genetische selectie van nageslacht. Het onderzoekt verder of en hoe het toevoegen van een kinderperspectief aan het discours de debatten kan verrijken en het juridisch beleid kan informeren die moeten aangenomen worden in dit gebied. Summary: This article examines one of the least explored aspects of assisted reproductive technologies (ART) – that is, the rights of ART-born children. Taking an international human rights law perspective, the article considers two arguable clashes of rights that have been raised with regard to ART-born children: the use of ART as child abuse and genetic selection of off spring. It further explores whether and how adding children’s perspective to the discourse may enrich the debates and inform the legal policies to be adopted in this regard. Wat daarentegen minder duidelijk is, is wat dit recht net omvat. Bijvoorbeeld, omvat de normatieve inhoud van dit recht ook een recht op een geboortecertificaat? Dit is een vraag die erg relevant is geworden voor Australische Minderheden, waarvan velen moeite ondervinden om een geboortecertificaat te verkrijgen. Dit artikel argumenteert dat het recht op geboorteregistratie, zoals uiteengezet in het Internationaal Verdrag inzake Burgerlijke en Politieke Rechten en het Verdrag inzake de Rechten van het Kind, impliciet een recht op een geboortecertificaat omvat. Summary: International human rights law has long recognised the right of every child to have their birth registered. However, what is less clear is what this right encompasses. For example, does the normative content of the right to birth registration include a right to a birth certificate? This is a question that has become very relevant to Indigenous Australians many of whom are experiencing difficulties acquiring a birth certificate. This article argues that the right to birth registration, as set out in the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, implicitly includes the right to a birth certificate. This conclusion is reached following an analysis of the work of the Human Rights Committee and the Committee on the Rights of the Child. Mensenrechten:Europees Verdrag voor de Rechten van de MensSamenvatting: De Court is het laatste decennium steeds meer betrokken in de uitvoering van de vonnissen. De traditionele benadering, waarbij de vonnissen van de Court enkel een aard van intentie zijn en waarbij de Committee of Ministers een exclusieve bevoegdheid hebben om toe te zien op de uitvoering, correspondeert niet met de tegenwoordige praktijk. De Court heeft herhaaldelijk algemene of individuele maatregelen aanbevolen of zelfs voorgeschreven, niet enkel voor pilot-vonnissen of quasi-pilot-vonnissen maar ook voor “gewone” vonnissen. Het is onbetwistbaar dat de Committee of Ministers de hoofdverantwoordelijkheid draagt op vlak van uitvoering. Niettemin zijn hun bevoegdheden niet exclusief. De Court heeft in dit opzicht een complementaire bevoegdheid. De rechtspraak heeft een wettelijke basis in de Convention, evenals in de instrumenten die onlangs aangenomen werden door de Committee of Ministers. Bij het geven van uitvoeringsmaatregelen is het echter noodzakelijk dat de Court het institutionele evenwicht uit de Convention behoudt en respecteert en, uit principe, een min of meer ruime beoordelingsmarge verleent aan de Staten. Summary: Over the last decade the Court has been progressively involved in the execution of its judgments. The traditional approach, according to which the judgments of the Court are only of a declaratory nature and the Committee of Ministers has an exclusive competence to supervise their execution, does not correspond to recent practice. The Court has repeatedly recommended or even prescribed general or individual measures in the framework not only of pilot or quasi-pilot judgments, but also of “ordinary” ones. It is uncontestable that the Committee of Ministers bears the primary responsibility in the field of execution. Nevertheless, its powers are not exclusive. The Court has a complementary competence in this respect. The relevant case law has a solid legal basis in the Convention, as well as in instruments recently adopted by the Committee of Ministers. However, when indicating execution measures it is necessary for the Court to maintain and respect the institutional balance provided in the Convention and to leave, as a matter of principle, a more or less wide margin of appreciation to States.
