Kinderrechten (algemeen):Participatie:AlgemeenSamenvatting: Dit onderzoek is deel van een Europees-project dat het welzijn van kinderen die slachtoffer werden van een internationale kinderontvoering door een van de ouders behandelt. Via een literatuurstudie en een rechtspraakanalyse, aangevuld met een online bevraging van ouders, face-to-face interviews met kinderen en face-to-face, telefonische of schriftelijke interviews met rechters, wordt in beeld gebracht welke impact een ontvoering en de procedure die erop volgt heeft op kinderen. Vertrekkend vanuit internationaal privaatrecht (Haags Kinderontvoeringsverdrag) en kinderrechten (VN Kinderrechtenverdrag) formuleert het onderzoek aanbevelingen over wat nodig is om kinderen beter te beschermen tegen een ontvoering en de gevolgen ervan, en hoe de stem van het kind daarin kan worden meegenomen. In het bredere EU-project (EWELL) worden de praktijken in België, Nederland en Frankrijk vergeleken. Summary: This research is part of a European project that investigates the welfare of children who were victims of an international child abduction by one of their parents. The project combines a literature review and case law analysis with an online survey of parents, face-to-face interviews with children and face-to-face, telephone or written interviews with judges. The aim is to get a better understanding of the impact on children of an abduction and the legal procedure that follows. Building on the framework of private international law (Hague Convention) and children’s rights (UN CRC), this research formulates recommendations on what is needed to better protect children against an abduction and its effects, and how the voice of the child may be included therein. In the broader EU project (EWELL), the practice in Belgium, the Netherlands and France is compared. MensenrechtenSamenvatting: Fragmentatie van internationaal recht is 'de opkomst van gespecialiseerde en (relatief) autonome regels of rechtssystemen'. Dergelijke gespecialiseerde rechtssystemen ontstaan als antwoord op specifieke problemen en hebben daardoor de neiging om de reeds bestaande regels van andere rechtsgebieden over het hoofd te zien. Deze verregaande specialisatie leidt tot conflicten tussen regels of rechtssystemen en tot inconsistenties in het internationaal recht. Dergelijke inconsistenties komen naar voren in de relatie tussen het internationaal familierecht (IFR) en de kinderrechten (KR), en in het bijzonder in zaken van internationale kinderontvoering. IFR probeert internationale kinderontvoering te voorkomen en ontmoedigen. Vandaar de prioritering van de onmiddellijke terugkeer van het kind wanneer ontvoering plaatsvindt. KR, als onderdeel van de mensenrechten, benadrukt het belang van het kind als eerste overweging. Er kan spanning zijn tussen terugkeer en de beste belangen van het kind. Het voorgestelde onderzoek zal de fragmentatie tussen IFL en KR onderzoeken in de rechtspraak van zes jurisdicties over internationale kinderontvoering. Summary: Fragmentation of international law is ‘the emergence of specialized and (relatively) autonomous rules or rule-systems’. Such specialized rule-systems emerge as a response to specific problems and thereby tend to overlook the already existing rules of other fields of law. This far-reaching specialization leads to conflicts between rules or rulesystems and to inconsistencies in international law. Such inconsistencies are apparent in the relation between International Family Law (IFL) and Children’s Rights Law (CRL), and in particular in cases of international child abduction. IFL seeks to prevent and discourage international child abduction. Hence it prioritizes the immediate return of the child. CRL, as part of human rights law, emphasizes the best interests of the child as a primary consideration. There can be a conflict between return and the best interests of the child. The proposed research will investigate the fragmentation between IFL and CRL in the case law of six jurisdictions on international child abduction. In de Praktijkgids staat het perspectief van kinderen en jongeren centraal. De Gids vertrekt van wat 44 kinderen en jongeren tussen 10 en 17 jaar uit Hongarije, Cyprus en België belangrijk vinden om mee te geven aan professionals die met een kinderontvoering in aanraking (kunnen) komen. De thema’s die aan bod komen zijn interactiestijl, informatie en dialoog, vertrouwensrelaties, ondersteuningsfiguren en een op rechten gebaseerde terugkeer. De Praktijkgids is het resultaat van een multidisciplinaire samenwerking tussen Hintalovon (Hongarije), Hope for Children (Cyprus), Missing Children Europe en Universiteit Antwerpen. Summary: The INCLDUE-project aims to enhance the wellbeing of children at all stages of an international child abduction by providing guidelines and good practices to legal and other professionals. Children’s perspectives are central to the Guide to Good Practice. The Guide is based on what 44 children and young people between 10 and 17 years old from Hungary, Cyprus and Belgium consider to be good practice for adults in a context of child abduction. Five themes are covered: interaction style, information and dialogue, relationships of trust and affection, supporting adults and rights-respecting return. Kinderrechten (algemeen):Participatie:AlgemeenSamenvatting: Het team heeft de jurisprudentie over internationale kinderontvoeringen in Europa geanalyseerd om erachter te komen: i) of en hoe rechters invulling geven aan het begrip "het belang van het kind"; ii) of rechters kinderen horen. De analyse omvat 938 nationale zaken uit 17 EU-landen (België, Bulgarije, Tsjechië, Kroatië, Finland, Frankrijk, Duitsland, Griekenland, Hongarije, Italië, Letland, Malta, Nederland, Polen, Roemenië, Zweden en Spanje). De jurisprudentie van het Europees Hof voor de rechten van de mens (EHRM, 54 zaken) en het Europees Hof van Justitie (EHvJ, 8 zaken) werd opgenomen voor zover dit het begrip van het begrip "belang van het kind" zou kunnen verbeteren. Tot de wettelijke bepalingen behoren het Verdrag van 's-Gravenhage van 1980 inzake ontvoering van kinderen, de EU-verordening Brussel IIbis en het Kinderrechtenverdrag. Het onderzoek bevestigde dat het beginsel van het belang van het kind steeds belangrijker wordt in internationale kinderontvoeringsprocedures in Europa. De verwijzing naar het beginsel lijkt echter niet algemeen en is niet homogeen verspreid over de geselecteerde rechtsgebieden. Uit de analyse blijkt dat de nationale rechtbanken moeilijkheden ondervinden bij de beoordeling van de belangen van het kind. Zij hebben de neiging prioriteit te geven aan het hoofddoel van het Haags Ontvoeringsverdrag, namelijk dat ontvoerde kinderen in beginsel snel moeten terugkeren naar het land van hun vroegere gewone verblijfplaats. Overeenkomstig de toonaangevende jurisprudentie van het EHRM in de zaken Neulinger en Shuruk tegen Zwitserland en X. tegen Letland kunnen rechtbanken echter geen mechanische terugkeer bevelen, maar moeten zij rekening houden met de situatie van het specifieke kind in het licht van de uitzonderingen van het Haags Ontvoeringsverdrag. Het is in die zin positief om te zien hoe rechtbanken proberen het beginsel van het belang van het kind te verzoenen met het verdrag. In feite wordt het beginsel van het belang van het kind vaak gebruikt in verband met de gronden voor niet-terugkeer van het Haags Ontvoeringsverdrag. Het begrip heeft niet tot gevolg dat het toepassingsgebied van de gronden voor niet-terugkeer van het verdrag wordt uitgebreid, maar het kan wel bijdragen tot een meer kindgerichte interpretatie van deze gronden. Ten slotte blijkt uit de analyse dat de nationale rechterlijke instanties vaak terughoudend zijn om kinderen te horen of er niet op vertrouwen dat zij hun eigen belangen kunnen beoordelen. Wanneer de rechterlijke instanties kinderen horen, houden zij meestal rekening met de mening van het kind om de belangen van het kind zo goed mogelijk te behartigen en om de mogelijke noodzaak van een of meer gronden voor niet-terugkeer te beoordelen. Summary: The team analysed case law on international child abductions in Europe to find out: (i) whether and how judges give substance to the notion of the best interests of the child; (ii) whether judges hear children. The analysis covers 938 national cases from 17 EU countries (Belgium, Bulgaria, the Czech Republic, Croatia, Finland, France, Germany, Greece, Hungary, Italy, Latvia, Malta, the Netherlands, Poland, Romania, Sweden and Spain). Case law from the European Court on Human Rights (ECtHR, 54 cases) and the European Court of Justice (ECJ, 8 cases) was included to the extent it could enhance the understanding of the notion of best interests. Legislative provisions include the 1980 Hague Child Abduction Convention, EU Regulation Brussels IIbis and the United Nations Convention on the Rights of the Child. The research confirmed that the principle of the child’s best interests is acquiring importance in international child abduction proceedings in Europe. Yet, reference to the principle does not appear broadly and is not homogeneously spread among the selected jurisdictions. It emerges from the analysis that national courts encounter difficulties in assessing the child’s best interests. They tend to prioritise the main goal of the Hague Abduction Convention, namely that abducted children should in principle return speedily to the country of their former habitual residence. However, in line with leading ECtHR case law in Neulinger and Shuruk v. Switzerland and X. v. Latvia, courts cannot order return mechanically, but must take into account the situation of the specific child in light of the Hague Abduction Convention’s exceptions. It is in this sense positive to see how courts attempt to reconcile the best interests principle with the Convention. In fact, the principle of the child’s best interests is frequently used in connection with the Hague Abduction Convention’s grounds for non-return. The concept does not have the effect of expanding the scope of application of the Convention’s grounds for non-return, but it can assist in a more child-centred interpretation of these grounds. Finally, the analysis shows that national courts are often cautious to hear children, or are reluctant to trust them to be able to assess their own interests. When the courts do hear children, they mostly take the child’s views into account to give substance to the child’s best interests and to assess the possible need to use one or several grounds for non-return.
