Vanuit een internationaal mensenrechtenperspectief, overweegt het artikel twee mogelijke clashes van rechten die ontstaan bij MBVT-kinderen: het gebruik van MBVT als kindermisbruik en een genetische selectie van nageslacht. Het onderzoekt verder of en hoe het toevoegen van een kinderperspectief aan het discours de debatten kan verrijken en het juridisch beleid kan informeren die moeten aangenomen worden in dit gebied. Summary: This article examines one of the least explored aspects of assisted reproductive technologies (ART) – that is, the rights of ART-born children. Taking an international human rights law perspective, the article considers two arguable clashes of rights that have been raised with regard to ART-born children: the use of ART as child abuse and genetic selection of off spring. It further explores whether and how adding children’s perspective to the discourse may enrich the debates and inform the legal policies to be adopted in this regard. Het analyseert de filosofische en praktische redenen voor het nalaten van het Kinderrechtenverdrag om de rechten van kinderen met een handicap te beschermen en het zoekt naar corrigerende maatregelen die aangenomen kunnen worden onder het Verdrag voor rechten voor personen met een handicap. Het aangehaalde argument is dat, vooral beschouwd vanuit het perspectief van kinderen, ondersteunende technologieën de kern zijn van nationale en internationale inspanningen om de rechten van kinderen met een handicap te verbeteren, en dan vooral het recht op inclusie. Het artikel overweegt de komende uitdagingen en trekt conclusies met betrekking tot de toekomst van de rechten van kinderen met een handicap. Summary: This essay contemplates the rights of children with disabilities under international law. It analyses the philosophical and practical reasons for the failure of the Convention on the Rights of the Child to protect the rights of children with disabilities, and looks at the remedial measures adopted under the Convention on the Rights of Persons with Disabilities (CRPD). The argument advanced is that, especially when children’s perspectives are considered, assistive technologies are at the heart of national and international efforts to advance the rights of children with disabilities, most importantly, a right to inclusion. I consider the challenges ahead and draw conclusions on the future of the rights of children with disabilities. Kinderen in kwetsbare situaties:Kinderen met een beperkingSamenvatting: Dit essay onderzoekt de wettelijke en morele implicaties van prenatale genetische selectie bij kinderen met een beperking. Het bouwt voort op academisch onderzoek over het politieke beleid van identiteit en cultuur om te onderzoeken of wetenschappelijke ontwikkelingen voor kinderen aanleiding geven tot een recht op ‘een behouden geest en lichaam’. Deze vraag wordt onderzocht in het licht van internationale mensenrechtennormen, inclusief het recente Europese Verdrag inzake de Mensenrechten en Biogeneeskunde, met nadruk op de het recht op identiteit dat kinderen bezitten. Een nieuw duaal model wordt benaderd, waarbij men de beslissingen in verband met de biogeneeskunde evalueert vanuit een model waarbij het kind centraal staat. Wat is de wisselwerking tussen het ouderlijke recht op voortplanting en kinderrechten? Op welke manier worden kinderen zelf betrokken in deze ontwikkelingen? Op welke manieren kunnen biogeneeskundige beslissingen vertaald worden in een taal die kinderen verstaan? En in welke mate komen wetenschappelijke technieken overeen met de erkenning van kinderen als maatschappelijke verantwoordelijk voor hun eigen rechten onder het Internationale Verdrag inzake de Rechten van het Kind? Summary: The essay examines the legal and moral implications of pre-natal genetic selection of disability in the context of children. This essay is build on scholarly literature on the politics of identity and of culture to explore whether scientific developments prompt a child’s “right to a sound mind and body.” This question is considered in light of international human rights standards, including the recent European Conventions on Human Rights and Biomedicine, and particularly, the child’s right to identity. A new dual model to evaluate such biomedical decisions from a child-centred approach is approached. What is the interplay between the parental right to reproductive freedom and the rights of the child? Where are the children themselves configured in these developments? How can such biomedical decisions be translated into the child’s voice? And to what extent do such scientific techniques correspond to the recognition of children under the International Convention on the Rights of the Child as social agents in their own right?
