Marshall het zich voorstelde was het sociale burgerschap een correctie voor het onrecht veroorzaakt door de kapitalistische markt. Aanspraken en bescherming, gegarandeerd door de welvaartsstaat zouden sociale en economische uitsluiting voorkomen, wat door burger- en politieke rechten alleen niet verzekerd kan worden. Bijgevolg zouden zulke beschermingsmaatregelen de sociale cohesie en solidariteit verzekeren, net zoals een productieve economie en markt. De Europese welvaartsstaten hebben op succesvolle wijze deze formule gevolgd voor het merendeel van de periode na Wereldoorlog II. Echter, in de laatste decennia zijn er significante veranderingen opgetreden. De betekenissen van ‘werk’ en ‘arbeider, waar de welvaartsstaat op is gebaseerd, zijn veranderd – flexibiliteit, risico en onzekerheid zijn definiërende elementen geworden van het arbeidersbestaan. De welvaartsstaat zelf heeft ook een transformatie ondergaan, en is in toenemende mate verschoven van een systeem van ‘passieve uitkeringen’ naar een systeem van ‘sociale investeringen’ in het menselijk kapitaal. Deze ontwikkelingen worden gekoppeld aan een grotere nadruk op onderwijs in het ‘actieve burgerschap’ dat deelnemende individuen voor ogen heeft die aanpasbaar zijn aan een toenemende geglobaliseerde samenleving en klaar zijn om bijdragen te maken op het lokale, nationale en transnationale niveau. Het opkomende Europese sociale project is gebaseerd op een herschikking van deze onderdelen: werk, sociale investeringen en actieve participatie. In dit artikel overweegt de auteur de implicaties van dit project voor immigrantenpopulaties, vooral in Europa, en voor de concepten van burgerschap en mensenrechten in het algemeen. In tegenstelling tot de recente kritieken op de neoliberale ommekeer en de terugkeer naar burgerschapsprojecten die de natie-staat centraal stellen in Europa, benadrukt de auteur de bredere tendensen in de periode na Wereldoorlog II, die een significante verandering aantonen in de funderingen van goed burgerschap en sociale rechtvaardigheid. Het nieuwe sociale project ontwikkelt een model van burgerschap dat de individualiteit en de daaraan verbonden transformatieve capaciteit als een collectief goed privilegieert. De auteur besluit dat in plaats van mensenrechten en burgerschap te behandelen als een dichotomie, men beter aandacht zou kunnen besteden aan hun vesrtrengelde gebruiken om hun contingente prestaties en mogelijke uitbreiding van het burgerschap in Europa te begrijpen. Summary: As envisioned by T.H. Marshall, social citizenship was a corrective to the injustices caused by the capitalist market. Entitlements and protections guaranteed by the welfare state would prevent social and economic exclusions that civil and political rights, on their own, simply could not. Such protections consequently would ensure social cohesion and solidarity, as well as a productive economy and market. European welfare states successfully followed this formula for the most part of the post-World War II period, However the last couple of decades witnessed significant changes. For one, the very meaning of ‘work’ and ‘worker’ on which the welfare state is based has changed – flexibility, risk, and precariousness have become defining elements of working life. The welfare state itself has gone through a transformation as well, increasingly moving away from a system of ‘passive benefits’ to ‘social investment’ in human capital. These developments are coupled with an emphasis on education in ‘active citizenship’, which envisions participatory individuals who are adaptable in an increasingly globalized society, and ready to contribute at local, national and transnational levels. The emergent European social project draws on a re-alignment between these strands: work, social investment, and active participation. In this article, I consider the implications of this project for immigrant populations in Europe in particular and for the conceptions of citizenship and human rights in general. In contrast to the recent commentary on the neoliberal turn and the return of nation-state centered citizenship projects in Europe, I emphasize the broader trends in the post-World War II period that indicate a significant shift in the very foundations of good citizenship and social justice. The new social project transpires a citizenship model that privileges individuality and its transformative capacity as a collective good. Thus, while expanding the boundaries and forms of participation in society, this project at the same time burdens the individual, rather than the state, with the obligation of ensuring social cohesion and solidarity, disadvantaging not only non-European migrants but also the ‘lesser’ Europeans. The new social project brings into focus the relationship between universalistic individual rights and their effective exercise. I conclude that rather than treating human rights and citizenship as a dichotomy we should pay attention to their entangled practice in order to understand the contingent accomplishments and possible expansions of citizenship in Europe. Mensenrechten:Europees Verdrag voor de Rechten van de MensSamenvatting: Het belangrijkste mensenrechteninstrument van de Raad van Europa is het Europees Verdrag voor de Rechten van de Mens (EVRM). Hierin worden de burgerlijke en politieke rechten vastgelegd die door de lidstaten gewaarborgd dienen te worden. Het EVRM is complementair met het Europees Sociaal Handvest, wat op zijn beurt economische, sociale en culturele rechten beschermt. Hoewel het Verdrag geen expliciete melding van kinderrechten maakt, zijn kinderen inbegrepen in de term “eenieder die ressorteert onder de rechtsmacht” van een lidstaat (art. 1). Het EVRM wordt ten uitvoer gebracht onder het toezicht van het Europees Hof voor de Rechten van de Mens in Straatsburg. Het Hof is bevoegd uitspraak te doen in individuele en interstatelijke verzoekschriften, alsook adviezen te verschaffen. Iedere Verdragsluitende Partij moet zich houden aan de uitspraken van het Hof en alle nodige maatregelen treffen om deze na te leven. De uitvoering van de vonnissen staat onder toezicht van het Comité van Ministers. De Theseus databank bevat analyses van rechtspraak van het Europees Hof voor de Rechten van de Mens, die relevant is voor kinderrechten. Summary: The Council of Europe’s main human rights treaty, known as the European Convention on Human Rights (ECHR), sets out the civil and political rights and freedoms that the Member States agree to ensure. It complements the European Social Charter, which on its turn guarantees economic, social and cultural rights. Even though the Convention makes no specific mention of children’s rights, the rights contained in the ECHR apply to “everyone” within the Member State’s jurisdiction (Article 1). This includes children too. The ECHR is enforced by the European Court on Human Rights in Strasbourg. The Court has jurisdiction to deal with individual complaints and inter-State petitions. In addition, it can issue advisory opinions. The parties to a case must abide by the judgments of the Court and take all necessary measures to comply with them. The execution of judgements is supervised by the Committee of Ministers. The Theseus database provides analyses of case law from the European Court of Human Rights relevant to children’s rights. Summary: International human rights law has long recognised the right of every child to have their birth registered. However, what is less clear is what this right encompasses. For example, does the normative content of the right to birth registration include a right to a birth certificate? This is a question that has become very relevant to Indigenous Australians many of whom are experiencing difficulties acquiring a birth certificate. This article argues that the right to birth registration, as set out in the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, implicitly includes the right to a birth certificate. This conclusion is reached following an analysis of the work of the Human Rights Committee and the Committee on the Rights of the Child. Het presenteert een aspect van het inzicht in burgerschap dat wordt voortgebracht uit onderzoek door zes groepen gemarginaliseerde kinderen, tussen de 5 en 13 jaar in Wales en Frankrijk. Door de beschrijving van de activiteiten samen te vatten van de onderzoeksgroep, die werden geassocieerd met de onderdelen van burgerschap van de theorieën over burgerschap, kan men zien hoe deze kinderen deelnemen in acties van burgerschap, met name regels opstellen over het sociale bestaan, het bevorderen van sociale goederen en het uitoefenen van vrijheden om zelf rechten te verkrijgen. Summary: This article develops understandings of children’s agency in citizenship and some of the different ways in which children’s actions enact them as interdependent citizens. It presents one aspect of the understanding of citizenship generated from research by six groups of marginalized children, aged 5-13, in Wales and France. Synthesizing the research groups’ descriptions of activities they associated with the component parts of citizenship with citizenship theory, these children can be seen to engage in actions of citizenship that include making rules of social existence, furthering social good and exercising freedoms to achieve their own rights. Their activities also transgress the boundaries of existing balances of rights, responsibilities and statuses, through their (mis)behavior, in ways that can be interpreted as Acts of citizenship. In children’s everyday activities, however, the distinction between actions and Acts of citizenship can at times be blurred. This is because recognizing aspects of children’s practices as citizenship is a challenge to dominant definitions of citizenship, and claims a new status for children. Exploring children’s citizenship in these ways has potential for widening understandings of participation and appreciating broader aspects of children’s agency in citizenship.
