Dit artikel handelt over het recht op inclusief onderwijs. Artikel 24 van het VN Verdrag voor de Rechten van Personen met een Handicap (IVRPH) houdt niet enkel in dat kinderen met een beperking niet mogen gediscrimineerd worden, maar ook dat ze in staat moeten zijn om deel te nemen in het algemene onderwijssysteem. Kinderen met een beperking zouden daarom onderwezen moeten worden in reguliere scholen. Het artikel start met het bestuderen van het recht op onderwijs in de internationale mensenrechtenwetgeving. Hierop volgt een algemene introductie over het IVRPH. Na een discussie over haar ontstaansgeschiedenis, volgt een analyse van Artikel 24 van het IVRPH, waarbij het concept van inclusief onderwijs onderzocht wordt, de plicht om redelijke accommodatie te voorzien en de verplichting om ondersteuningsmaatregelen te treffen. Hierbij wordt de vraag gesteld of speciale scholen nog steeds beschikbaar zouden moeten zijn. |

This article deals with the right to inclusive education. Article 24 of the UN Convention on the Rights of Persons with Disabilities (CRPD) provides not only that children with disabilities should not be discriminated against but also that they should be able to participate in the general education system. Children with disabilities should therefore be educated in mainstream schools. The article begins by studying the right to education in international human rights law (Section 2). It continues with a general introduction to the CRPD (Section 3). After discussing its drafting history, the article goes on to analyse Article 24 of the CRPD, examining the concept of inclusive education, the duty to provide reasonable accommodation and the obligation to adopt support measures and asking the question whether special schools should still be available (Section 3). |
