Kinderrechten (inter)nationaal:Landen en regio's:Azië & Pacific:Nieuw ZeelandSamenvatting: Dit artikel benadrukt het gebrek aan erkenning van mensenrechten voor een van de meest kwetsbare groepen in onze samenleving, namelijk kinderen en jongeren binnen de zorg georganiseerd door de staat. De wetgeving en beleidskaders binnen Nieuw-Zeeland garanderen de rechten van deze kinderen niet ondanks de verplichtingen die Nieuw-Zeeland heeft ten aanzien van de UN Conventie inzake de Rechten van het Kind (UNCRC). Dit is van groot belang voor de zorg en bescherming van kinderen die nood hebben aan dergelijke zorg op het moment dat de overheid de verantwoordelijkheid heeft om dergelijke rechten te realiseren naast hun directe verantwoordelijkheid als 'zakelijke ouder'. Dit artikel onderzoekt de kwetsbaarheid van deze groep en de mogelijke wijzes waarop de rechten uit de UNCRC niet gerealiseerd worden door de huidige wetgeving en beleidsontwikkelingen. Men gaat bepaalde wijzigingen in de benadering van de wetgeving en beleidsontwikkelingen aanraden. Summary: This article highlights the lack of human rights recognition for arguably one of the most vulnerable groups in our society, children and young people in the care of the state. Currently under New Zealand legislation and policy frameworks these children do not have their rights upheld, as per New Zealand’s obligations under the United Nations Convention on the Rights of the Child (UNCRC). This is particularly important for the care and protection of children needing state care as the government has the responsibility as a state body to ensure their rights are upheld, alongside their direct responsibilities as the ‘corporate parent’. This article explores the vulnerability of this group and the ways in which their rights under UNCRC are not being met by current legislation and policy. It goes on to recommend changes to the way in which we approach legislative and policy development. Mensenrechten:AlgemeenSamenvatting: Deze paper stelt een denk- en werkwijze voor rond kinderbescherming door gebruik te maken van principes van gemeenschapsontwikkeling om de praktijk te begeleiden. Er wordt voorgesteld dat een nuttige bijdrage aan de gemeenschapsontwikkeling kan gehaald worden uit de bepalingen die betrekking hebben op kinderrechten in de Mensenrechtenverdragen. Dit artikel toont aan dat in erg verschillende situaties van verschillende omgevingen, een gemeenschapsontwikkeling in lijn met de principes van de rechten van het kind een goede uitkomst kan leveren voor risicokinderen. Er wordt een model gepresenteerd voor de unificatie van de wereldvisie op mensenrechten/kinderrechten met de voornaamste bezorgdheid van sociaal werk, de bescherming van kinderen, door gebruik te maken van gewoonlijke vaardigheden uit sociaal werk. Summary: This paper presents a way of thinking about and doing child protection work using community development (CD) principles to guide practice. It suggests that a useful addition to CD can be found within the rights of the child provisions in Human Rights conventions. This article demonstrates that in very different situations from different environments, CD in concert with the principles of the rights of the child can assist good outcomes with children at risk. A model is presented for unifying the worldview of human/children's rights with social work's core concern, the protection of children, using generic social work skills. Kinderrechten (inter)nationaal:Landen en regio's:Europa:Verenigd KoninkrijkSamenvatting: De groei van de onafhankelijke instellingen voor kinderrechten (meestal bekend als Kindercommissaris en Ombudsman) is in recente jaren dramatisch geweest, vooral in de Britse Eilanden en in Europa in het algemeen. Dit artikel herziet enkele van de belangrijke kenmerken van zulke instellingen, en enkele belangrijke verschillen. Er wordt in het bijzonder nadruk gelegd op twee zaken: onafhankelijkheid, in de zin van onafhankelijkheid van de overheid alsook onafhankelijkheid van ruimere mensenrechteninstellingen, en impact. Een discussie over de methodologische en praktische moeilijkheden in het inschatten van de impact wordt gevolgd door een case study over een recente poging om de impact van een nationale instellingen te evalueren. Summary: The growth of independent children's rights institutions (usually known as Children's Commissioners and Ombudsmen) has been dramatic in recent years, in the British Isles and in Europe more generally. This article reviews some of the key characteristics of such institutions, and some of the key differences between them. It focuses in particular on two issues: independence, in the sense of independence from government and also independence from broader human rights institutions, and impact. A discussion of the methodological and practical difficulties in assessing impact is followed by a case study of a recent attempt to evaluate the impact of one national institution. The article concludes by suggesting that the demand for evidence of impact is likely to grow, reflecting the growing ambitions of independent children's rights institutions and the pressures on public funding. Mensenrechten:AlgemeenSamenvatting: Door een leemte tussen wettelijke verplichtingen ten aanzien van mensenrechten en de reële situatie, is controle een essentieel onderdeel van het internationale en nationale mensenrechtensysteem, aangezien dit de situatie van mensenrechtenverplichtingen weergeeft en de relevantie van de instrumenten verzekert. Maar hoe wordt deze controle uitgevoerd? Het artikel onderzoekt de controle in relatie met de rechten van het kind en presenteert een analyse over hoe actoren deze controle interpreteren en uitvoeren, en de significantie van de verschillende benaderingen. Dankzij de verschillende afwegingen van de actoren over kinderrechten in het proces zelf, wordt er een essentieel verschil gemaakt tussen twee benaderingen tot controle, die gedefinieerd worden als ‘lineair’ en ‘circulair’. De invloed van deze benaderingen ten aanzien van controle wordt bediscussieerd in relatie met: het ontwarren van de rechten; het gebruik van hulpmiddelen; en limitatie van het proces. De paper toont aan dat de controle complex is met verschillende problemen en significante keuzes die gemaakt moeten worden, om de waarde van de verschillende contributies te kunnen inschatten. Summary: Due to the lacunae between legal obligations to human rights and the actual situation, monitoring is an essential component of the international and national human rights system as it illuminates the situation of human rights commitments and ensures the relevancy of instruments. But how is monitoring carried out? The article explores monitoring in relation to the rights of the child and presents analysis about how actors interpret and execute monitoring and the significance of different approaches. Due to actors’ different considerations of child rights in the process, an essential distinction is made between two approaches to monitoring, which are defined as ‘linear’ and ‘circular’. The influence of these approaches upon monitoring is discussed in relation to: the untangling of rights; tool use; and limiting the process. The paper demonstrates that monitoring is complex with numerous issues and significant choices to be made that determine the value of various contributions. In sum, identifying these approaches assists critical analysis of the results. Veel onderzoek heeft zich gericht op de benarde situatie van niet-begeleide, vluchtelingen- en asielzoekerskinderen, die beter proberen om kinderen te verbinden rechtenoverwegingen met het internationale vluchtelingenrecht. Veel publicaties richten zich op de het belang van het kind en het recht om te worden gehoord. Het meeste onderzoek richt zich op (migratie naar) Europa. Dit heeft geleid tot een grotere zichtbaarheid en erkenning van rechten van kinderen in het kader van de migratie. Er zijn echter nog steeds verschillende blinde vlekken in het onderzochte onderzoek. De meeste onderzoeken richt zich op sommige kinderen, maar niet op alle (bijv. begeleide kinderen), op sommige rechten, maar niet alle (bijvoorbeeld economische, sociale en culturele rechten), en op sommige soorten migratie, maar niet allemaal (bijv. economische migratie). Bovendien hebben vluchtelingen- en migrantenkinderen de neiging om als groep worden bestudeerd, waardoor de aandacht voor hun interne diversiteit dreigt af te nemen. Summary: This article presents a tentative analysis of 30 years of academic research in the field of children’s rights and migration (1989–2019). Much research has addressed the plight of unaccompanied, refugee and asylum-seeking children, trying better to link children’s rights considerations with international refugee law. Many publications address the best interests of the child principle and the right to be heard. Most research focuses on (migration towards) Europe. This has led to an increased visibility and recognition of children’s rights in the context of migration. However, there are still various blind spots in the research reviewed. Most research focuses on some children, but not all (e.g., accompanied children), on some rights, but not all (e.g., economic, social and cultural rights), and on some types of migration, but not all (e.g., economic migration). Moreover, refugee and migrant children tend to be studied as a group, which risks reducing attention for their internal diversity.
