In de uitloop van het tweede millennium zijn er twee facultatieve protocols aan het Verdrag toegevoegd in 2000 (het facultatief protocol betreffende de verkoop van kinderen, kinderprostitutie en kinderpornografie en het facultatief protocol betreffende de betrokkenheid van kinderen bij gewapende conflicten). De nood voor een communicatieprocedure werd voorgesteld vanaf het begin van het ontwerpproces. Dit artikel zal de ontwikkelingen bespreken die hebben geleid tot de oprichting van een open werkgroep voor de uitwerking van een communicatieprocedure, 3e facultatief protocol bij het IVRK. Bezorgdheden, vragen en de discussie over de omvang en de inhoud van het facultatief protocol zullen verder worden uitgewerkt. Summary: The adoption of the Convention on the Rights of the Child by the UN General Assembly in 1989 marked a shift in paradigm from viewing children as the possession of parents and objects of welfare to individuals with rights. At the outset of the second millennium, two optional protocols to the Convention (Optional Protocol on Children in Armed Conflict and Optional Protocol on Sale of Children, Child Prostitution, Child Pornography) were adopted in 2000. The need for a communications procedure was suggested from the very beginning of the drafting process. This article will discuss developments leading to the establishment of an open-ended working group for the elaboration of a communications procedure, 3rd Optional Protocol to the CRC. Kinderrechten (algemeen):Participatie:Participatie aan beleidSamenvatting: Dit artikel bespreekt het concept van multigenerationeel burgerschap. Het artikel stelt dat om burgerschap voor kinderen relevant te maken, een meer flexibele en relationele benadering van burgerschap noodzakelijk is. Er wordt voortgebouwd op de theorieën van Tom Paine, door het onderzoeken van de toenemende aanvaarding van de autonomie van een kind om klachten aan te brengen bij mensenrechtenorganen, zowel door internationale en regionale fora, zowel op het vlak van politieke rechten als van mensenrechten. Het artikel onderzoekt de recente ontwikkelingen in de beweging richting de oprichting van een klachtenmechanisme onder het IVRK en stelt dat dit een belangrijk bestanddeel is van internationaal kinderburgerschap. Het artikel onderzoekt tevens de vooruitgang die door nationale rechtbanken wordt gemaakt naar een kinderburgerschap, wat heeft bijgedragen tot de internationale consensus om een internationale rechtsmiddel te voorzien voor schendingen van kinderburgerschapsrechten. Het artikel vergelijkt de toenemende aanvaarding van kinderen als internationale burgers door het Europees Hof voor de Rechten van de Mens en onder het speciaal ontworpen Afrikaans Handvest inzake de rechten en het Welzijn van het Kind. Summary: This article discusses the author’s concept of multigenerational citizenship, arguing that for citizenship to be relevant for children, there needs to be a more flexible and relational approach to citizenship. Tom Paine’s theories are expanded upon, by examining the increasing acceptance, by both international and regional fora in both political and human rights, of a child’s autonomy in bringing complaints to a human rights body. The article examines the recent developments in the move toward establishing a complaints mechanism under the Convention on the Rights of the Child (CRC) and argues that this is an important element of international child citizenship. The article also examines the progress made in national courts toward child citizenship, which has helped to change the international consensus on providing an international remedy for breaches of child citizenship rights. The article compares the growing acceptance of children as international citizens by the European Court of Human Rights and under the specially designed African Charter on the Rights and Welfare of the Child’s complaints mechanism. Het analyseert de toegevoegde waarde van het Protocol in de realisatie van het recht behoudende de gezondheid van kinderen. Dit gebeurt door het analyseren van de integratie van het participatierecht van kinderen in het Protocol en welke invloed dit heeft op de mogelijkheid om een klacht neer te leggen rond de tekortkomingen in de realisatie van de economische, sociale en culturele rechten, en dan vooral het recht op gezondheid voor kinderen. In de conclusie worden manieren gesuggereerd om kinderen meer kansen te geven om actief betrokken te zijn bij het opkomen voor hun eigen recht op gezondheid. Summary: This contribution sketches the background and development of the Optional Protocol on a Communications Procedure for Children under the Convention on the Rights of the Child. It analyzes the additional value of the Optional Protocol for realizing children’s right to health. It does so by analyzing how children’s right to participation is integrated in the Protocol and how this influences the possibility to make complaints on deficits in realizing economic, social and cultural rights, most specifically children’s right to health. It concludes by suggesting ways to strengthen opportunities for children to become actively involved in advocating for their own right to health.
