Een beweging die de rechten van geadopteerden ondersteunt, heeft geijverd voor toegang tot informatie over hun oorsprong; biologische ouders krijgen meer en meer iets te zeggen in de selectie van de families voor de kinderen; en adoptieouders hebben gereageerd op de beleidsveranderingen door middel van hun eigen organisaties. De verschillen in perspectieven van de drie hoeken van de triade werden vaak zomaar aangenomen zonder te testen of deze inderdaad overeenkwamen met de werkelijkheid. Deze paper geeft verslag over een studie met 1007 participanten (geboorteouders en geadopteerden) in reünies minsten 1 jaar voor de dataverzameling en rapporteert over hun standpunten over de openheid, toegang tot informatie en de reünie. Een kleine restrictieve sample van 175 antwoorden van de adoptieve ouders van de participanten werden ook mee opgenomen. Hoewel er verschillen bestonden in de perspectieven van de groepen, vond de studie meer convergentie dan divergentie. Participanten (zowel mensen die zochten en zij die gezocht werden) waren het eens dat de reünie-diensten beschikbaar zouden moeten zijn voor iedereen die deze optie zoekt. Meer dan 90% van de mensen die zochten en mensen die gezocht werden meldden dat de reünie een positieve ervaring was. Summary: In recent years, adoption policy has been influenced by a number of socio-cultural and political factors. An adoptees-rights movement has pushed for access to information about their origins; birth parents increasingly seek a voice in selecting their children's families; and adoptive parents have responded to policy changes through their own organizations. Differences in the perspectives of the three corners of the triad have often been assumed without testing. This paper reports on a study of 1007 participants (birth parents and adoptees) in reunions completed at least 1 year prior to data collection and reports on their views of openness, information access, and reunion. A small restrictive sample of 175 responses from the adoptive parents of participants is also included. Though there were some differences in the perspectives of these groups, this study found more convergence than divergence. Participants (both searchers and search subjects) agreed resoundingly that reunion services should be available to anyone who seeks that option. Over 90% of all searchers and search subjects reported that reunion was a positive experience. Summary: The Hague Convention on the Protection of Children and Co-operation in Respect of Intercountry Adoption does not fully protect children from the purportedly well-intended, but illegal, humanitarian impulses to evacuate children in times of crisis, as evidenced by Operation Babylift and the attempt to airlift children from Chad. De Draft wordt gezien als een belangrijke stap, zowel omdat het de nodige update inhoudt voor het 1967 Europees verdrag inzake adoptie van kinderen (ETS No. 58), alsook omdat het relevante internationale standaarden aanvult. Volgens PACE past het toekomstige verdrag perfect in het kader van de RvE strategie “building a Europe for and with children”. Het zet het concept van het belang van het kind centraal binnen adoptieprocedures, in overeenstemming met gevestigde rechtspraak van het EHRM. Een aantal amendementen worden voorgesteld om de Draft te verbeteren. Summary: In this opinion, PACE welcomes the preparation of the draft convention of the Council of Europe on the adoption of children (revised). It regards this draft as a significant and necessary step forward, given the general recognition of the need to update the 1967 European Convention on the Adoption of Children (ETS No. 58), and the way in which the draft complements relevant international standards. PACE finds the future revised convention to be perfectly integrated with the CoE strategy “building a Europe for and with children”. It makes the concept of the child’s best interests central to adoption procedures, in accordance with the well-established case law of the European Court of Human Rights. A number of amendments are proposed with a view to improve the draft convention.

Gezin:Gezag en omgangSamenvatting: De samenleving is sinds de invoering van het Burgerlijk Wetboek in de 19de eeuw grondig gewijzigd. Het huwelijk is niet langer de hoeksteen van de samenleving en de ontwikkelingen in de medische wetenschap openen heel wat nieuwe mogelijkheden om tegemoet te komen aan een kinderwens. In deze bijdrage wordt onderzocht in welke mate het Belgisch recht inzake de vestiging van ouderlijk gezag nog aangepast is aan deze nieuwe maatschappelijke realiteit. Vastgesteld wordt dat het Belgisch recht in onvoldoende mate rekening houdt met de geschetste ontwikkelingen. Dit heeft tot gevolg dat het op sommige punten strijdig is met de mensenrechten. Gelet op de diversiteit aan gezinssituaties moet met de concrete omstandigheden steeds meer rekening kunnen worden gehouden bij de vaststelling van de afstamming en de organisatie van het ouderlijk gezag. Dit vereist tevens een zorgvuldig besluitvormingsproces met gepaste aandacht voor de mening van het minderjarige kind. Afstamming blijft bij voorkeur het aanknopingspunt voor ouderlijk gezag, maar op het niveau van de uitoefening moet op soepele en evenredige wijze erkenning kunnen worden gegeven aan de rol die derden in het leven van een minderjarige spelen. Kinderen geboren uit een gelijkslachtige relatie moeten bovendien op gelijkwaardige wijze kunnen genieten van deze rechtsbescherming. Summary: The society has changed profoundly since the implementation of the Code Civil in the 19the century. Marriage is no longer the basic rule of society and developments in the medical science has opened a lot of new possibilities to meet the desires for a child. In this article will be examined if the Belgium law concerning the attachment of parental authority is adapted to this new social reality. The article proofs that Belgium law does insufficiently takes into account the described developments. This has as consequence that it violates the human rights. Due to the diversity of family situations one should take, by the establishment of filiation and the organization of parental authority, still more the specific circumstances into account. This requires also a careful decision making process that pays due attention to the views of the child. Filiation stays by preference the point of attach for parental authority, but at the level of its exercise, it should be able to give on an easy and proportional way recognition to the role third people plays in the life of a minor. Children born out same-sex relationships should furthermore be given legal protection in an equal way.
